Following the European harmonization of the procedure with regard to large hydro-electric projects as referred to in Article 11b(6) of Directive 2003/87/EC, as amended by Directive 2004/101/EC, Belgium has adopted two documents:

  • the guidelines on a common interpretation of Article 11b(6) of Directive 2003/87/EC, as amended by Directive 2004/101/EC, and
  • the compliance report which assesses the extent to which Article 11b(6) of the Directive on emissions trading applies to the activities of hydro-electric projects with an installed capacity exceeding 20 MW.

From the 1st of July 2009, each project promotor that wishes to obtain a Letter of Approval (LoA) from the Belgian DNA for a hydro-electric project with an installed capacity over 20 MW,will have to fill-in these new documents and will have to be assessed as being in accordance with the required conditions.
